MPs back regulations establishing Sh2 billion Public Prosecutions Fund

A parliamentary committee has approved regulations that will establish a Sh2 billion Public Prosecutions Fund designed to strengthen the work of the Office of the Director of Public Prosecutions and improve the way complex criminal cases are handled.

The move is expected to give prosecutors the financial support needed to deal with complicated investigations, pursue cases more effectively and support efforts aimed at recovering assets linked to crime.

Director of Public Prosecutions Renson Ingonga presented the proposal on Thursday when he appeared before the National Assembly Committee on Delegated Legislation, explaining the purpose of the fund and how it will support the prosecution office in its operations.

“The initial capital of the fund shall be Sh2 billion appropriated by the National Assembly in the 2026/2027 financial year,” Ingonga said.

He told the committee that the establishment of the Public Prosecutions Fund will help the ODPP strengthen its capacity when handling difficult criminal investigations and prosecutions, while also supporting efforts to trace and recover assets obtained through unlawful activities.

Ingonga said having a dedicated fund for prosecution work will improve the efficiency of the justice system by ensuring that prosecutors have the resources required to pursue cases and support anti corruption initiatives.

The DPP also outlined the different sources from which the fund will receive money apart from allocations approved by Parliament.

According to Ingonga, the fund will benefit from grants and donations, deferred prosecution agreements and proceeds that arise from plea agreements reached in criminal proceedings.

Other sources will include funds generated from preservation orders issued during criminal proceedings, compensation and restitution orders granted by courts and interest earned from investments made using the fund.

The committee considered the proposal while reviewing the Public Finance Management (Public Prosecution Fund) Regulations, 2025, which provide the legal framework for the establishment and management of the fund.

Members of the Committee on Delegated Legislation supported the proposal, noting that the fund will help improve the speed and effectiveness of delivering justice to the public.

The committee is chaired by Ainabkoi Member of Parliament Samuel Chepkong’a, who said the regulations had undergone careful examination before being approved.

Chepkong’a explained that the Statutory Instruments Act, 2013 gives the committee the responsibility to examine regulations and other legal instruments issued by government institutions to ensure they meet legal standards and protect the interests of the public.

“We have reviewed the regulations and are satisfied that they conform to the law and comply with the Statutory Instruments Act, 2013,” he said.

After approving the regulations, the committee said it will prepare a report and forward it to the National Assembly for discussion and final approval by lawmakers.

The planned Sh2 billion fund is expected to provide the ODPP with stable financial backing to strengthen prosecutions, support anti corruption efforts and ensure criminal cases are handled more efficiently.

Members of the committee said the fund will play an important role in improving the justice system, especially when dealing with complex investigations and initiatives aimed at recovering assets connected to criminal activities.
